Valentina Sarai Diamonds – Terms and Conditions

Please read these Terms and Conditions (the “Conditions of Sale”) carefully before placing an order on www.valentinasarai.com (the “Website”).

By placing an order on the Website, you agree to these Conditions of Sale. These terms apply only to orders placed through the Website and do not apply to purchases made through other sales channels or in-store.

I. Updates to the Conditions of Sale

We may update these Conditions of Sale from time to time. The most current version will always be available on the Website. Any updates take effect immediately upon posting. Changes made after you place an order will not affect that order, except where required by applicable law.

II. Purchasing Eligibility

As a dealer in precious metals, diamonds, and fine jewelry, Valentina Sarai Diamonds and its affiliated entities comply with the U.S. Bank Secrecy Act (BSA) and FinCEN regulations.

We reserve the right to refuse any sale that does not meet our internal compliance requirements.

By placing an order, you confirm that you are a bona fide end-user purchasing for personal use and not for resale or commercial distribution.

III. Product Availability & Quantity

  • All orders are subject to availability and acceptance by us.
  • Some items may be made-to-order and require additional production time.
  • Quantity limits may apply to certain items.
  • We reserve the right to refuse or cancel any order or portion of an order at any time, including due to suspected fraud, pricing errors, or compliance concerns.

IV. Prices, Taxes & Shipping Costs

  • Prices listed on the Website exclude sales tax and shipping unless otherwise stated.
  • Taxes are calculated based on the shipping destination.
  • Prices and shipping costs are subject to change without notice.
  • In the event of a pricing error, we reserve the right to cancel the order and issue a full refund if necessary.

V. Shipping & Delivery

  • We currently ship within the United States only. International shipping is not available.
  • For security reasons, we do not ship to PO boxes. PO boxes may be used for billing purposes.

Shipping Options:

  • USPS Priority Mail (orders under $50): $15
  • FedEx 2-Day Express: $45
  • Free shipping on orders over $500
  • Delivery timeframes are estimates and may vary depending on production timelines and carrier delays.
  • Orders may ship in multiple packages.
  • A shipping confirmation email will be sent once your order has shipped and constitutes acceptance of your order.
  • Signature confirmation is required upon delivery. If a recipient other than you signs, this will be considered proof of delivery and transfer of responsibility.
  • We reserve the right to request ID verification upon delivery.

If delivery is delayed due to circumstances beyond our control (including but not limited to weather, carrier delays, or supply chain disruptions), we will notify you. If your order is not delivered within 30 days of shipment confirmation, you may request cancellation and a refund for undelivered items.

VI. Payment

  • Accepted payment methods are displayed at checkout.
  • Additional verification or identification may be required to process your payment.
  • By placing an order, you authorize us to perform security and fraud prevention checks, including verification with third-party providers.
  • We do not conduct transactions with individuals or entities listed on the OFAC Specially Designated Nationals (SDN) list or in sanctioned regions.

VII. Returns & Exchanges

     

    • Valentina Sarai Diamonds sincerely hopes that you will be satisfied with any Product(s) you purchase from us. However, given that all of our Products, whether Shop Products or Custom Products, take several days to weeks or even months to create, we do not offer any returns or refunds for any Products you purchase.
    • In the unusual event that you receive a Product that arrives damaged, you must notify us immediately by emailing valentinasaraidiamonds@gmail.com.
    • Such notice must be sent no later than twenty-four (24) hours after you receive delivery and must include your name, email address, and a picture along with a written description of the damaged Product. You must also return the damaged Product to us at the address provided at your cost. We will discard and will not respond to any damage notice that does not comply with these requirements.
    • If your damage notice does comply with these requirements, we will then forward the matter to our insurance provider, VAAX Shipping Inc. If the insurance claim is accepted, then upon such notice from VAAX Shipping Inc, we will notify you via email, at which point we will commence production of a replacement Product to send to you free of charge.

    VIII. Repairs & Services

    • We offer professional jewelry services including resizing, polishing, cleaning, and repair.
    • We may decline repairs on items altered by non-authorized jewelers.
    • Repairs outside of warranty coverage may incur fees.
    • Any replaced components may be retained by Valentina Sarai Diamonds unless otherwise required by law.

    IX. Limitation of Liability

    To the fullest extent permitted by law, our total liability shall not exceed the amount paid for the product(s).

    Some jurisdictions do not allow limitations on certain warranties or liabilities, so parts of this section may not apply to you.

    X. General Provisions

    • If any provision is found to be invalid or unenforceable, the remaining provisions remain in effect.
    • These Conditions of Sale represent the entire agreement between you and Valentina Sarai Diamonds regarding your purchase.
    • A waiver of any breach does not constitute a waiver of future breaches.

    XI. Arbitration & Dispute Resolution

    • Any disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA), except for qualifying small claims court matters.
    • You waive your right to a jury trial and to participate in class-action lawsuits.
    • Arbitration will take place in your state of residence or in Franklin, Tennessee, at your election.
    • Before initiating arbitration, both parties agree to attempt to resolve disputes informally for a period of 30 days.

    XII. Governing Law

    These Conditions are governed by the Federal Arbitration Act and the laws of the State of Tennessee, without regard to conflict-of-law principles.

    XIII. Security & Privacy

    • We implement reasonable physical, electronic, and administrative safeguards to protect your personal information.
    • You are responsible for maintaining the confidentiality of your account credentials.
    • We are not liable for unauthorized account access due to compromised passwords.
    • Personal data is retained only as long as necessary and then securely deleted or anonymized.
    • Third-party services operate under their own privacy policies.
